If you do not agree, please do not use our services. For institutional subscriptions and bespoke agreements, these terms may be supplemented by a written contract; in the event of conflict, the written contract governs. Use of Services
Access to TrendInvest services may require registration and acceptance of an account agreement. Users must provide accurate information and maintain the confidentiality of credentials. Access granted for evaluation or trial is limited to the specified scope, and redistribution of trial content is not permitted. Clients integrating our API must follow our authentication, rate limit, and security guidelines; misuse or attempts to reverse-engineer proprietary signals are prohibited. We reserve the right to suspend or terminate access for breach of these terms, security concerns, or misuse. Payment obligations for subscription services must be met on schedule and are non-refundable unless otherwise stated in a written contract. If an enterprise agreement exists, that agreement's billing and termination provisions will control. Users are responsible for compliance with laws applicable to their jurisdiction when using our services, including restrictions on data export and financial advisory permissions.
Intellectual Property and Content
All content, research, signals, datasets, visualizations, code samples, and other materials provided by TrendInvest are the intellectual property of TrendInvest or its licensors and are protected by copyright, database rights, and other intellectual property laws. Clients receive a limited, non-exclusive license to use licensed materials strictly in accordance with their subscription or contract. Redistribution, resale, sublicensing, or public posting of content without express written permission is prohibited. Where clients receive derived datasets or white-label reports under contract, usage rights will be defined in that contract. Users may not remove or alter proprietary notices. If you believe we have used your copyrighted material improperly, please contact [email protected] with a detailed notice so we may address the issue promptly. TrendInvest may use aggregated or anonymized client data for research and quality improvement provided individual client data is not disclosed in identifiable form, unless required by contract or consented to by the client.
Disclaimer of Investment Advice and Limitation of Liability
TrendInvest provides research, signals, and analytical content for informational purposes only. Nothing on our site or delivered through our services constitutes investment advice, an offer, or a recommendation to buy or sell any security, derivative, or other financial instrument. Users should not rely solely on TrendInvest content for making investment decisions and should consult qualified professionals as appropriate. To the fullest extent permitted by law, TrendInvest disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. TrendInvest does not guarantee the accuracy, completeness, or timeliness of content and will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of or inability to use our services, including lost profits or business interruption, even if advised of the possibility of such damages. For clients with written agreements, liability caps and indemnities are specified in the contract, which will govern to the extent of any conflict with these terms.
Privacy, Data Security, and Retention
TrendInvest processes personal data in accordance with the Privacy Policy located at /privacy/. We implement reasonable administrative and technical safeguards to protect client and user data and provide contractual protections for enterprise clients. Clients are responsible for the data they provide to TrendInvest and must ensure they have the right to transmit such data. We retain data only as necessary to provide services, comply with legal obligations, and meet contractual retention periods. For API clients, logs and usage metrics are retained for operational monitoring and billing purposes. In cases where law requires disclosure, TrendInvest will cooperate with valid legal processes and notify affected clients when permitted.
Governing Law and Dispute Resolution
These terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. Any dispute arising out of or relating to these terms or TrendInvest services will be resolved through the procedures set forth in an applicable written agreement. Absent a written agreement specifying alternative dispute resolution, parties agree to submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York. Nothing in these terms prevents either party from seeking injunctive relief in any court of competent jurisdiction when necessary to protect intellectual property rights or to prevent irreparable harm. If any provision of these terms is held unenforceable, the remaining provisions will remain in full force and effect. TrendInvest may update these terms from time to time; material changes will be posted on this page and, where appropriate, notified to users and clients in advance.
